Fit Range Terms and Conditions

Fit Range is a trade name of Left Side AI, Inc. References to “Fit Range,” “we,” “us,” and “our” mean Left Side AI, Inc. d/b/a Fit Range. These Terms govern the Fit Range website and our inquiry, waitlist, and founding-membership interest forms. When you submit a form that requires acceptance of these Terms, you agree to them. Please save a copy for your records.

Our planned golf simulator location is inside Team Eckenrode Gym & Fitness at 4961 Nicholson Court, Kensington, MD 20895. Sharing this location does not mean Fit Range operates the gym.

These Terms do not themselves create a paid membership, authorize a recurring charge, or replace a separate membership agreement or facility participation agreement. Our Privacy Policy explains how we handle personal information.

Fit Range provides its golf simulator services. Team Eckenrode Gym & Fitness independently operates the gym and provides its gym access, fitness equipment, fitness programming, and any training services it offers. Fit Range does not operate or supervise Team Eckenrode’s gym services or employ its trainers merely because those services are available at the same location.

A Fit Range simulator membership does not by itself grant access to the gym, its equipment, classes, or personal training. Gym participation requires Team Eckenrode’s separate authorization and enrollment requirements. Any advertised option involving both simulator and gym access consists of services supplied by separate operators. The provider, price, payment recipient, enrollment requirements, and cancellation terms for each component will be disclosed before you become obligated to pay.

Questions about gym operations, gym equipment, gym access, gym billing, gym refunds, or gym training should be directed to Team Eckenrode. Questions about Fit Range simulator services should be directed to Fit Range. Neither business is authorized to change the other’s agreement merely because they share a location or promote services together.

Fit Range does not undertake responsibility for independently supplied gym services solely by referring you to Team Eckenrode or describing its offerings. This description of separate services does not release either business from responsibility for its own acts or omissions, eliminate duties imposed by law, or determine responsibility for a particular incident. Nothing in these Terms waives a claim for injury caused by negligence or other wrongful conduct.

Submitting an inquiry, joining a waitlist, or selecting a founding-membership preference through an interest form is free and nonbinding. It does not purchase a membership, reserve a simulator booking, guarantee a membership place, or authorize a payment. An automated confirmation acknowledges receipt of your request only.

If you request membership information, we may contact you about the option you selected, enrollment availability, and related opening details. You may withdraw your interest at any time by contacting us. Separate choices govern optional marketing communications.

Opening dates, proposed equipment, membership availability, operating hours, booking allowances, and proposed prices may change before enrollment. We will identify the actual offer before asking you to purchase. A founding designation does not promise lifetime pricing, perpetual access, priority bookings, or other benefits unless those benefits are expressly included in your membership agreement. Any advertised limit or deadline must correspond to the actual offer.

Before accepting a paid membership, deposit, or booking, we will provide the applicable agreement and material terms, including the service provider, charges and taxes, term, start date, access and booking limits, payment schedule, cancellation and refund rules, and any renewal arrangement.

An interest-form submission is not consent to automatic renewal. Any recurring billing authorization must be separately and clearly presented at enrollment. Applicable statutory cancellation, refund, and consumer protection rights remain available and cannot be reduced by these Terms. A paid membership agreement governs its specific membership terms, subject to applicable law.

Our online inquiry and membership interest forms are intended for adults age 18 or older. Provide accurate contact information and submit information only about yourself or someone you are authorized to represent. A parent or guardian should contact us about participation by a minor rather than have a child submit a form. Minor participation, if offered, is subject to separate eligibility, supervision, and enrollment requirements.

Do not submit payment card numbers, government identification numbers, passwords, or medical information in an inquiry or interest form.

Submitting an interest form does not authorize facility entry or equipment use. Before participating, follow the enrollment, orientation, booking, and safety requirements of the business providing the activity.

Golf simulation involves moving clubs and balls, ball rebound, physical exertion, and nearby equipment. Participants must follow posted safety instructions, keep others clear of the swing area, use equipment as directed, and promptly report hazards or damaged equipment. Do not use equipment while impaired or when you cannot do so safely. We may stop unsafe activity.

This description of risks is not an injury-liability release. Facility participation requirements will be supplied separately before use. Fit Range does not provide medical advice or guarantee health, fitness, or golf-performance outcomes.

You may use the website for lawful personal inquiries and evaluation of our services. You may not impersonate another person, submit fraudulent requests, upload malicious material, attempt unauthorized access, interfere with the website, or collect other users’ personal information without authorization.

Fit Range and its licensors retain their rights in the website’s original text, graphics, logos, and other protected content. You may save these Terms and information about your own inquiry or purchase. Other copying or commercial use requires permission unless allowed by law. Third-party names and marks belong to their respective owners.

If you send us a message or suggestion, you authorize us to use it to respond and operate or improve our services, consistent with the Privacy Policy. Submitting a message does not authorize us to use your name, image, or comments as a public testimonial without separate permission.

We aim to keep the website accurate, but it may contain errors or experience interruptions. We may correct information and will disclose material offer changes before enrollment. Nothing in this section excuses misleading advertising, changes an accepted agreement without the required process, or limits a remedy required by law.

Links, embedded services, and third-party websites may have their own terms and privacy policies. Review those documents before providing information or purchasing a third party’s services. Linking to a provider does not make Fit Range the operator of that provider’s business.

We may update these Terms by posting a new effective date. Updated Terms govern future submissions after the applicable notice and acceptance process. Changes do not retroactively alter an existing paid agreement or a dispute that has already arisen. We will request renewed acceptance when required.

Maryland law governs these Terms, subject to any mandatory protections that apply to you. Disputes may be brought in a court with lawful jurisdiction; these Terms do not impose mandatory arbitration, waive a jury trial, or require you to give up a statutory remedy. You may contact us to seek an informal resolution, but doing so is not a prerequisite to exercising a legal right.

If a provision is unenforceable, the remaining provisions continue to apply to the extent permitted by law. Failure to enforce a provision once does not waive future enforcement. Nothing in these Terms removes a right or obligation that applicable law does not permit the parties to waive.
